    Eviction notice

    This is a sad day.. as I gave my leasing agent permission to file against my renters an eviction today.

    They have lived in my house for two years..are ever late with payment.. last month was Sept 24th when they were able to pay the rent and there is no payment for this month. The rent is due on first of the month, w/ contract that reads "eviction will be filled on 10th of months when rent has not been paid." I learned today that my renters pay their bills with a credit card.. which reveals much about their budget and the probability of continued tension with them in regard to rent payment

    as I stated.. this is a sad day for all of us

    .. I am faced with asking them to leave..or supporting them.. I cannot afford to support them.. I have let students live in my home for free and did support a music minister and his family for a year.. now I feel like I need the support myself ... so as I said.. this is a sad day

    Judy, my husband and I, too, have been landlords. Some renters are good and easy to have, others are not so. I understand your feelings today, I really do. I will add my prayers to those being said for you today, and I will also pray for those tenants -- clearly, they need some changes in their lives, whatever those may be.

    Thank you Marian...my tenants are sweet Christian people.. IMO they are in desperate need of a good financial planner. My prayer is they will not allow their pride from admitting and seeking this service, they will have a place to live that is safe and the financial sinkhole they are now in will slowly turn around so the entire family will learn from lessons God has for them. I will tell you that I thank God I have a home lease agent and the hard "in-your-face-issues are not mine to bear..

    We own rental homes and I professionally manage 60+ single family homes. Eviction is always a last choice for owners/managers and is often expensive and difficult. But it is the only legal way to get use and possession of your property back from those that either are not paying the rent or are otherwise violating their rental agreement.

    I have only had to do one eviction because I have usually been able to demonstrate to the tenant that it is in their best interest to quickly vacate the home without forcing an eviction process. Evictions (unlawful detainer lawsuits) are public record and will be visible to future landlords doing rental application background checks. No property manager in their right mind would rent to an applicant with a record of eviction. Once the tenant understands the future consequences of forcing an eviction action, they usually quickly move out and surrender the property. I give them a short deadline (less than two weeks) to surrender the home in excellent condition and often offer a concession regarding legal action to recover lost rent. This is a win/win for all parties. Evictions are expensive and time consuming for the owner and devastating for the tenant's record. Best to avoid it when possible. But often tenants don't understand the benefit to them of quickly moving on and avoiding the eviction. Hopefully your lease agent spent some time explaining the situation and attempting to negotiate a quick vacancy. If a tenant is short sighted or stubborn enough to ignore such helpful options, then they deserve the eviction and all the consequences.

    Either way, you deserve the full use and benefit of your property and you do not have to suffer anyone taking the use of your property without payment. Nothing to feel guilty about.

    Wow, excellent answer - Send this to Dave M. and ask him to include in the book he is working on. - Here is my reasoning. - I've had folks in my church come to me struggling with this very issue. How do you evict a brother in Christ? (Sometimes they go to church together) - Tough, tough stuff. I've never had a good answer for that. That answer really does create some possibilities for a less emotionally violent way out. - I'm serious. every pastor and Christ follower that is a landlord needs to read this response. - The thanks button was not enough.

    I have often heard it said, "It is better to give than to receive." That is certainly true about eviction notices.

    We own a couple rental properties (single-family houses), and fortunately we've not bumped into this yet. We look forward to the day when the properties are all paid off and we have the luxury of supporting people (like the students and minister you mentioned) with free or reduced rent. Of course, we also look forward to the dramatically-increased income those properties will produce when the mortgages are paid off, too.
